USER AUTHORIZATION AGREEMENT
This User Authorization Agreement constitutes a legal and binding agreement between a user
(hereinafter referred to as “you”, “your” and “the user”) of the Electronic Declaration System (eDS)
and the Integrity Commission. This agreement, is to be read in conjunction with the Terms and Conditions of Use,
and shall govern the rights and obligations of the user and the Integrity Commission in respect of the use of the eDS.
Once you access the eDS, it is your responsibility to read the Terms and Conditions of Use.
- Authorized Use
- You agree not to use the eDS for any fraudulent or otherwise unlawful purpose or any purpose
prohibited under these Terms and Conditions or any applicable law. You agree not to use the eDS in any way that
could damage or compromise the website or general business of the Integrity Commission. You agree not to use the
eDS in any manner that interferes with the website or any other user’s use of the eDS. The Integrity Commission
reserves the right to seeks all remedies available at law for violation of these Terms and Conditions, including
but not limited to the right to block access from the eDS.
- Governing Law and Jurisdiction
- This agreement is governed in all respects by the Laws of Jamaica and must be construed,
applied and interpreted in accordance with those laws.
- Privacy
- Please see the provisions of the Terms and Conditions of Use as it relates to
the privacy of your data in the utilisation of the eDS.
- Registration

As a user of the eDS, you will be required to create and register
an account for the submission of your statutory declaration.
- By using the eDS, you agree that the information you submit is truthful,
complete, accurate, not misleading and offered in good faith. It will be your responsibility
to update your registration data should there be any changes.

When you register, it is for a single user only and your username and password is for your exclusive use only.
You are responsible for maintaining the confidentiality of your login credentials and you agree not to share your
login credentials with any unauthorized parties. You also agree to notify us promptly of any unauthorized use of
your login credentials or any other breach of security that you become aware of involving or relating to the eDS by emailing us.

The Integrity Commission reserves the right to take any and all action, as it deems necessary or reasonable
to maintain the security of the eDS and your account, including without limitation, terminating your account,
suspending your account, or requesting information to authorize changes to your account.
WE EXPLICITLY DISCLAIM LIABILITY FOR ANY AND ALL LOSSES AND DAMAGES ARISING FROM YOUR FAILURE TO COMPLY WITH THIS SECTION.
- Consent to Communication

If you provide us with a telephone number, residential or commercial address, or electronic mail address,
you expressly agree that the Integrity Commission, its employees or agents, can use that number,
residential or commercial address or electronic mail address to contact you.

When you use the eDS, you are communicating with the Integrity Commission electronically.
You consent to send and receive electronically, any communications related to your use of
the eDS. We may communicate with you by email or by posting notices on the eDS.
You agree that all agreements, notices, disclosures and other communications that
are provided to you electronically shall satisfy any legal requirement that such
communications be in writing. All notices from the Integrity Commission intended
for receipt by a user in connection with the eDS shall be deemed delivered and
effective when sent to the email address provided by the user on or through the eDS.
- Limitation of Liability

THE INTEGRITY COMMISSION, ENDEAVOURS TO THE BEST EXTENT POSSIBLE, TO MAKE THE eDS,
AVAILABLE AT ALL TIMES AND TO ENSURE THE SECURITY OF THE SYSTEM. HOWEVER,
THE COMMISSION SHALL NOT BE LIABLE IN THE EVENT THAT THE SYSTEM BECOMES
PARTIALLY OR WHOLLY UNAVAILABLE FOR ANY PERIOD OF TIME DUE TO TECHNICAL ISSUES
BEYOND ITS CONTROL, OR IS SUBJECT TO A CYBER-ATTACK. THE COMMISSION ASSUMES NO
LIABILITY FOR INACCURATE, INCOMPLETE OR ERRONEOUS INFORMATION PROVIDED BY THE
USERS OF THE EDS IN THE ELECTRONIC SUBMISSION OF THEIR STATUTORY DECLARATIONS.
THE COMMISSION ASSUMES NO LIABILITY FOR EXPENSES INCURRED IN THE PREPARATION OF
STATUTORY DECLARATIONS. ANY EXPENSES INCURRED IN CONNECTION WITH THE PREPARATION
OF A STATUTORY DECLARATION OR OTHER DOCUMENT REQUIRED TO BE SUBMITTED PURSUANT TO
THE INTEGRITY COMMISSION ACT, SHALL BE DEEMED TO BE MADE OR INCURRED BY THE DECLARANT
WHOLLY AND EXCLUSIVELY. PURSUANT TO THE INTEGRITY COMMISSION ACT, 2017 NO PROCEEDINGS
WHATSOEVER SHALL LIE AGAINST THE COMMISSION OR ANY PERSON AUTHORIZED BY THE COMMISSION,
FOR ANYTHING DONE, REPORTED OR SAID BY THE COMMISSION IN THE PERFORMANCE OF ITS FUNCTIONS
UNDER THE ACT, SAVE AND EXCEPT FOR PROCEEDINGS ON THE GROUNDS OF GROSS NEGLIGENCE,
MALICE OR THE USE OF UNREASONABLE FORCE.
- Severability

If any provision of this agreement is held by a court or other tribunal of competent
jurisdiction to be void, illegal or unenforceable for any reason, such provision
shall be eliminated or limited to the minimum extent such that the remaining provisions
of the agreement will continue in full force and effect.

By registering an account with the eDS, you agree that you have read and understood this Agreement and agree to comply with the above terms.
